Clubbing of Jaya cases: Orders posted for June 27
BANGALORE, June 23 (UNI) Special Judge A S Pachhapure, trying the Disproportionate wealth and London hotel cases against Tamil Nadu Chief Minister J Jayalalithaa, today posted to June 27 orders on the clubbing of the two cases for trial.
When the court met for the day, Narendra, counsel for former MP T T V Dinakaran, cited as the second accused in the London Hotel case, sought adjournment on the ground that his senior B Kumar could not attend the proceedings.
Refusing to postpone pronouncing of the orders in the matter beyond June 27, Justice Pachhapure said Dinakaran's counsels could present their arguments within the next two days.
The Special Court was to have passed orders on the clubbing of the cases yesterday as both the parties had concluded arguments.
While the accused favoured clubbing saying that the registration of a separate case was only to give Jayalalithaa never-ending hardship, the prosecution opposed it.
However, Jyothi had filed an application on June 21, urging the Special Court to consider the application of one of the accused Ilavarasi for trying the cases under Criminal Procedure Code (CrPC).
The application was filed in the wake of Madras High Court disposing of Ilavarasi's petition, seeking clarification of its earlier order in January, 2002, stating that the Special Court was competent to decide on the issue and observing that any court of law would have to adhere to and decide the matter before it strictly with reference to the CrPC.
The day's proceedings lasted for just 15 minutes.
