Bail application of gang rape accused rejected

JAMMU, June 20 (JNF): Court today rejected the bail application of a gang rape accused.

3rd Additional Sessions Judge Jammu (Vacation Sessions Judge) Sanjay Gupta rejected the bail application of Mohammad Aslam involved in a gang rape.

According to brief facts emerging from the case dairy and the report that on April 29, 2008 at about 5:30 in evening victim was going to Bazaar for purchasing, when she reached shop of Fakar Din, accused persons identified as Mohammad Yousuf, Mohammad Aslam and Liaqat Ali forcibly took her in near by room and all the accused persons forcibly committed rape upon her.

After committing the rape all the accused fled away from the spot.

An FIR was registered under section 376, 341 and 34 RPC and during the investigation, statements of witness under section 161 CrPC was recorded.

The statements of victim under section 161 and 164-A of CrPC were also recorded.

The accused Mohammad Aslam was arrested on May 3, 2008.

Court after hearing APP GS Charka appearing for the state and counsel for the accused observed that keeping in view whole circumstances of case and law pronounced by J&K High Court, Court thinks it not a fit case for grant of bail at this stage and the present application is rejected.
