'Abstract laws can cause confusion' In an animated discussion on 'limits of Law', Professor Peter H Schuck, Professor of Law Yale University, engaged a fully packed hall with the faculty members of Kashmir University.Professor Peter said that Law has many limitations.
He listed the lacunae in Law from the liberation , functional and legitimacy point of view.
" Law written in a improper and abstract way causes confusion.
Its decontextualised nature is problem.
Emphasis on seeing things in black and white, leaving no room for gray areas is a constraint.
It's inability to move as fast as the society is an impediment.
Dependence on limited and biased information by the plaintiff and the defendant in a hurdle.
Slow judicial process is a negation of the very ideals for which legal system stands", Professor Peter pointed out.
He explained and suggested corrective measures to help restore legitimacy and effectiveness of Law in society.
He observed that the transactional cost should be minimised so as to enable people to seek redressal of their grievances at an affordable price.
" The Law makers should be responsive to the diversity and the dynamics of the situation.
The gap between the Law in the books and the Law in action be bridged", he proposed.
He implored the teachers, students and the proffesionals of Law to think why Law today disappoints and does not generate hope.
While responding to a query, Professor Peter admitted that in view of serious limitations of Law other institutions in the society have to play a role to make people Law abiding.
"Religion can help to motivate people to live and lead a clean and honest life", he remarked.
** A function was organised in the Kashmir University at the Kashmir University alumni primary school, at Anchar Soura Srinagar.
The University officials claim that it was the first function of its kind.
The function was attended by children and citizens.
Among others General Manager Punjab National Bank,Harwant Singh was also present in the function.
In his keynote address, General secretory KUTA, Proffessor Mohi-U-Din threw light on the endeavors being made by the alumni association.
Speaking on the occasion, the chief guest, Harwant Singh appreciated the efforts of the association.
It is in place to mention here that Kashmir University Alumni Association (KUAA) was established with the support of Punjab National Bank (PNB).
Reacting to the allegation that B.Ed colleges were the money-making machines, the University authorities refuted this allegation and said that these colleges have been contributing towards the betterment of education in the state.
** The distinction holders of class 12th representing different higher secondaries of the Valley had an interactive session with the Kashmir University Vice chancellor, Prof.
Jalees Ahmad Khan Tareen, under the programme,'Meet the Eminent'.
The function was organised by the cultural wing of the Kashmir University.
"This will encourage these students to achieve further goals in their life", said cultural officer G H Gurku.
